§ 22-252. Enclosure of pools.

  • Every owner, purchaser under contract, lessee, tenant or licensee of a lot of premises located within the city upon which a private swimming pool is situated shall maintain at all times on such lot or premises a fence or other structure completely surrounding such pool, not less than four feet in height, with no gaps or apertures, other than doors or gates, with any dimensions greater than six inches. All gates or doors opening through a fence or enclosure, maintained in accordance with this section, shall be equipped with self-closing and self-latching devices placed at the top of such gates or doors and made inaccessible to small children. Such devices shall be designed to be capable of keeping such doors or gates securely closed at all times when not in actual use, provided, however, that the door of any dwelling forming a part of the enclosure need not be so equipped. Such enclosures shall be erected before operation of the pool. This requirement is subject to the following exceptions:

    (1)

    A rigid-wall or tube-supported pool with a depth of 48 inches or greater which is accessible only by a lockable ladder shall be exempt from this requirement.

    (2)

    Any pool with a depth of 48 inches or greater which is surrounded by a deck the same height as the pool shall be exempt from this requirement if the deck is accessible only by self-closing gate with childproof latch.

    (3)

    Any in-ground pool equipped with an automatic pool safety cover capable of supporting multiple persons.
